These Terms of Service (“Terms”) govern your access to and use of the ShareYourThoughts platform, website, dashboard, mobile interfaces, SMS interactions, and related services (collectively, the “Service”) operated by Keen Apps, LLC dba ShareYourThoughts (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the platform, you represent that you meet this requirement.

3. Description of the Service

ShareYourThoughts provides tools for businesses and consumers, including:

  • Review collection and automation
  • User-generated content (UGC) submissions
  • Referral programs
  • Customer surveys
  • Rewards, incentives, and affiliate offers

  • Analytics and dashboard features

The Service may evolve over time with new functions, features, or modifications.

4. Business Accounts

Businesses using the Service agree to:

  • Provide accurate account information
  • Maintain confidentiality of login credentials
  • Ensure that their use of the platform complies with all applicable laws
  • Obtain any necessary consents from their customers for messaging, rewards, and incentives

We are not responsible for how businesses choose to use, promote, or integrate the Service.

5. Consumer Accounts

Consumers who use the platform, redeem offers, submit content, or participate in incentives agree to:

  • Provide accurate personal information
  • Not misuse or fraudulently trigger rewards
  • Not impersonate others or submit false reviews
  • Follow any additional terms presented during offer redemption or UGC submission

6. Rewards and Offers

The platform may display rewards, incentives, affiliate offers, discounts, and third-party promotions.

You acknowledge and agree:

  • Offers may change, expire, or be discontinued at any time
  • Offer descriptions are provided by third-party merchants
  • We do not guarantee availability, accuracy, or fulfillment of third-party offers
  • Some offers may generate affiliate commissions for ShareYourThoughts or its partners
  • Redemption terms are controlled by the merchant or affiliate network

We are not liable for issues arising from third-party goods, services, or promotions.

7. User-Generated Content

You may submit reviews, photos, videos, text, or feedback (“User Content”). By submitting User Content, you grant us a worldwide, nonexclusive, royalty-free license to:

  • Use, display, store, reproduce, and distribute the content
  • Share the content with the business you interacted with
  • Use it in marketing, analytics, or improving the Service

You represent and warrant that:

  • You own or have rights to the content
  • Your content does not infringe on any third-party rights
  • You will not submit harmful, defamatory, or illegal material

We may remove or moderate content at our discretion.

By using the Service, you consent to receive:

  • SMS messages
  • Emails
  • In-app notifications
  • Automated communications related to reviews, rewards, or referrals

You may opt out at any time by following the opt-out instructions provided in the messages.

Standard messaging and data rates may apply.

9. Fees and Payments (Businesses)

Businesses may be billed for:

  • Subscription plans
  • Add-on features
  • Usage-based components
  • SMS or communication credits
  • Promotional placements

All fees are posted at checkout or within the platform. Payments are non-refundable except where required by law.

We may change pricing with notice.

10. Prohibited Activities

You may not:

  • Interfere with or disrupt the Service
  • Attempt to bypass security measures
  • Use bots, scripts, or automated methods without permission
  • Reverse-engineer, copy, or misuse the platform
  • Use the Service for fraud, spam, or misleading communications
  • Harvest data from other users or businesses
  • Publish or upload malicious code

Violation may result in account suspension or termination.

11. Intellectual Property

All content, code, branding, software, and design associated with the Service belong to Keen Apps, LLC dba ShareYourThoughts or its licensors and are protected by applicable intellectual property laws.

You may not reproduce or redistribute any part of the Service without written permission.

The Service may contain links to third-party websites, merchants, or affiliates. We do not control, endorse, or assume responsibility for third-party content, policies, or services.

You access third-party links at your own risk.

13. Service Modifications

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any changes or interruptions.

14. Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • You misuse the Service
  • Your activity causes risk or liability
  • Nonpayment (for business accounts)

You may stop using the Service at any time.

15. Disclaimer of Warranties

We make no warranties of any kind, express or implied, including:

  • Availability
  • Reliability
  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

You use the Service at your own risk.

16. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, consequential, or punitive damages
  • Our total liability for any claim will not exceed the amount paid by the business during the previous 12 months, or $100 for consumer users, whichever is greater
  • We are not liable for losses resulting from third-party offers, merchant actions, reviews, data breaches, or customer misuse

Some states do not allow certain limitations, so some terms may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Keen Apps, LLC dba ShareYourThoughts from any claims, damages, liabilities, or expenses arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of third-party rights

18. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflicts-of-law principles.

Any disputes shall be resolved in the state or federal courts located in Fulton County, Georgia.

19. Changes to These Terms

We may update these Terms at any time. The “Effective Date” at the top will reflect the most recent version. Continued use of the Service means you accept the updated Terms.
